Terms of Service

Welcome to IndBase Cloud. These Terms of Service (“Terms”) represent a legally binding agreement between you (the “Customer”, “Developer”, or “User”) and NexForge Services LLP(“we”, “us”, or “our”), governing your access to and use of our managed database cloud, BaaS APIs, auth gateways, storage directories, and command-line interfaces (collectively, the “Service”).
By registering an account, subscribing to waitlists, or purchasing our Founder Pass, you agree to comply with and be bound by these Terms. If you do not agree, you must immediately cease all use of our Services.
1. Account Creation & API Key Security
- Credentials Integrity: You must provide accurate, complete information when creating accounts. You are solely responsible for all actions occurring under your account.
- API Key Custody: IndBase provides secure database connection strings and project API keys. You must secure these credentials from public access. We are not liable for database drops, unauthorized auth modifications, or resource utilization surges resulting from compromised API tokens.
2. Pricing, Billing, & Founder Pass Terms
- Localized Billing: Subscriptions are priced and charged in Indian Rupees (INR) or US Dollars (USD). Tax assessments (GST/VAT) are applied based on customer business location.
- Founder Pass Lifetime License: Purchase of the Founder Pass awards a perpetual, lifetime license to specified storage quotas and compute capacities. Quotas remain subject to standard platform fair-use policies and system boundaries.
3. Acceptable Use Policy
You agree not to use IndBase for:
- Any illegal activities, including hosting unlawful materials, copyright infringement, or unauthorized personal identification processing.
- Mining cryptocurrencies, launching Distributed Denial of Service (DDoS) campaigns, or probing database infrastructures without authorization.
- Reverse engineering the core backend architecture, routing layers, or AI agent compiler modules.
4. Service SLAs & Operational Outsource
While we manage the operational complexity of backups, failovers, and routing to help you focus on writing code, you acknowledge that managed cloud environments are subject to system adjustments:
- We target a 99.9% uptime SLA for production database instances.
- Scheduled maintenance windows are announced at least 48 hours in advance.
- Backup restoration speeds depend on database storage volume.
5. Disclaimers of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. NEXFORGE SERVICES LLP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, COMPLETELY SECURE, OR FREE FROM DATA TRANSMISSION ERRORS.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY GOVERNING LAW, IN NO EVENT SHALL NEXFORGE SERVICES LLP BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, REVENUE, OR DATA CUSTODY LIABILITIES) ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL CUMULATIVE LIABILITY IS LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU TO INDBASE CLOUD IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
7. Governing Law & Dispute Resolution
These Terms shall be governed by, interpreted, and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms, our Services, or our operations shall be subject to the exclusive jurisdiction of the competent courts located in Delhi, India.
8. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify customers of major policy modifications via email or through dashboard console announcements. Continued utilization of the Service following revisions constitutes your binding acceptance of the updated Terms.
